H1B 每年有一定的年度配額，20,000 優先配是分配給有碩士學位者，65,000 給其他一般申請者，但若有碩士學位申請者擠不進 20,000 配額，則也可一起參與 65,000 的配額
H1-B的年度是每年的十月至明年的九月，且在每年的四月一日就可開始提出申請.
不像 今年2009 年的 2010 年度的 H1B visa 還尚有名額, 在過去這幾年因為四月一日就已收到近 100,000 件的申請，所以在過去有所謂的 H-1B 抽籤，這樣的抽籤與綠卡抽籤是不同的.
